La emergencia sanitaria en Ecuador por la pandemia del Covid-19, no solo nos cambió la dinámica de nuestra cotidianidad, sino también la realidad jurídica. Cuando hablamos de derechos laborales invocamos la regulación de las obligaciones bilaterales dentro del ámbito del trabajo, definición de acuerdo con el Diccionario Jurídico Elemental de Cabanellas (2016). Tanto la Ley Orgánica del Servicio Público- LOSEP, como el Código del Trabajo no han previsto, que la emergencia sanitaria causada por el Covid-19 acarrearía una oleada de despidos incumpliendo las garantías constitucionales por las que son amparados los trabajadores en el Ecuador. Es importante mencionar, que la pandemia no es un escenario fácil en el mundo entero, pero no es justificable que la terminación de las relaciones laborales en el Ecuador se haya convertido en un mecanismo para salvaguardar la economía de las empresas, dejando de lado el derecho de los trabajadores en un momento donde existe mayor vulnerabilidad social.
The sanitary emergency in Ecuador due to the Covid-19 pandemic, not only changed the dynamics of our daily life, but also the legal reality. When we talk about labor rights, we invoke the regulation of bilateral obligations within the scope of work, definition according to the Elementary Legal Dictionary of Cabanellas (2016). Both the Organic Law of Public Service- LOSEP, as well as the Labor Code have not foreseen that the health emergency caused by Covid-19 would lead to a wave of layoffs in breach of the constitutional guarantees by which workers are protected in Ecuador. It is important to mention that the pandemic is not an easy scenario worldwide, but it is not justifiable that the termination of labor relations in Ecuador has become a mechanism to safeguard the economy of companies, leaving aside the right of workers at a time when there is greater social vulnerability.
