La necesidad de simplificación de los instrumentos procesales para garantizar la tutela judicial efectiva frente a la administración del estado.

El problema de esta situación, yace en que existe una variedad extensa de instrumentos procesales para realizar estos actos contra el estado, y no solo cuando se tratan situaciones contra él, sino en general en el ejercicio de la función administrativa. Esta variedad en casos de procesos de derecho privado como las litigaciones civiles, seria bien recibida, puesto que le daría la posibilidad a quien inicie la acción de poder, por una u otra vía, reclamar judicialmente lo que alegue le corresponde. Pero tratándose de casos contra el estado, esta situación tiene un efecto distinto, el cual es pernicioso para quien inicia la acción, puesto que, al haber tanta diversidad no es posible un control real sobre esta actividad. Esto crea una afectación directa al principio de tutela judicial efectiva, protegido por la constitución de la república ecuatoriana, así como cada uno de los cuerpos legales que plasman actos procesales.
The problem lies in the existence of an extensive diversity of procedural tools to achieve the actions against the state, in general in the exercise of the administrative power, not only in actions against it. This diversity may be well accepted in the cases of private right processes, like civil litigation, since it gives whoever begins the action, the possibility to judicially claim what belongs to him. But talking about processes against the state, this effect is differe nt, becoming pernicious to whom initiates the action, since there wouldn’t be a real control over this activity with too much diversity. This creates a direct damage to the effective judicial protection principle, protected by the ecuadorian republic constitution, as well as each of the legal bodies that contain procedural acts.
