El derecho de alimentos constituye una facultad jurídica a través de la cual el acreedor alimentario obliga al deudor de proveerlos de todo lo indispensable para subsistir: vestido, habitación, asistencia médica, educación e instrucción. La fijación de alimentos voluntaria se trata de una intención libre, autónoma y deliberada de cumplir con una obligación y, por tanto, se aleja de convertirse en un mandato judicial. El ordenamiento jurídico ecuatoriano, en sus diversos órganos legales, acoge y defiende este derecho y obligación ciudadana. En este contexto, se hace necesaria una investigación que a través de su sustento bibliográfico, teórico y judicial demuestre la vialidad de esta consignación alimenticia frente al notario público y de acuerdo a las leyes civiles y constitucionales del país.
The right to food is a legal obligation through which the food creditor obliges to comply with the necessary requirements to survive: clothing, housing, medical assistance, education and instruction. The establishment of voluntary food is a free, autonomous and deliberate intention to comply with an obligation and, therefore, it moves away from becoming a judicial mandate. The Ecuadorian legal system, in its various legal bodies, welcomes and defends this right and civic obligation. In this context, an investigation must be made that goes through its bibliographical support, the theorist and the judicial defense demonstrate the viability of this food consignment before the notary public and according to the civil and constitutional laws of the country.
