La herencia, se encuentra dentro del derecho civil y sucesiones. Las disposiciones de este concepto jurídico están establecidas en el código civil. Es un instrumento jurídico en la cual se viene aplicando desde la antigüedad, dando así el nacimiento del testamento y la necesidad de regular estas acciones. Por lo tanto, el primer capítulo se explicará el origen de este instrumento jurídico, su evolución, elementos, clases y sus características. En el segundo capítulo nos entraremos al desarrollo del problema jurídico, además de analizar las causas que nuestra legislación otorga para la no herencia, el repudio o persona indigna. Lo cual, veremos e implementaré a mi criterio con base jurídica, la implementación de causales nuevas, pues a la realidad de los hechos, es menester la adición y aplicación de ciertas conductas al lecho de la muerte de la persona quien sus bienes deja a persona indignas.
Inheritance is within civil law and inheritance. The provisions of this legal concept are laid down in the civil code. It is a legal instrument in which it has been applied since ancient times, thus giving the birth of the will and the need to regulate these actions. The first chapter will therefore explain the origin of this legal instrument, its evolution, elements, classes and its characteristics. In the second chapter we will enter into the development of the legal problem, in addition to analyzing the causes that our legislation grants for non-inheritance, repudiation or unworthy person. Which, we will see and implement in my judgment with legal basis, the implementation of new causalities, because to the reality of the facts, it is necessary to add and apply certain behaviors to the deathbed of the person who his property leaves unworthy person.
