El estudio en cuestión tiene como objetivo principal promover la reforma al Código Orgánico Integral Penal que faculte la legalización del porte y tenencia de armas de tipo traumáticas en el Ecuador para la protección y defensa de los ciudadanos que realizan actividades comerciales. Esto debido al aumento de la delincuencia e incidentes violentos que atraviesa el país siendo uno de los principales afectados los ciudadanos propietarios de negocios en el país por parte de las bandas criminales contra las autoridades en beneficio de la ciudadanía. Se especifica la información necesaria como la composición, efectos, ventajas y desventajas de este tipo de armas. Finalmente, con estas consideraciones se propone una reforma al COIP donde se agreguen los artículos 360.1, 360.2 y 360.3 que legalizan la tenencia y porte de arma, las personas habilitadas y los motivos para su uso, respectivamente.
The main objective of the study in question is to promote the reform of the Comprehensive Organic Criminal Code that authorizes the legalization of carrying and possession of traumatic weapons in Ecuador for the protection and defense of citizens who carry out commercial activities. This is due to the increase in crime and violent incidents that the country is going through, one of the main affected being citizens who own businesses in the country by criminal gangs against the authorities for the benefit of the citizenry. The necessary information such as the composition, effects, advantages and disadvantages of this type of weapon is specified. Finally, with these considerations, a reform to the COIP is proposed where articles 360.1, 360.2 and 360.3 are added, which legalize the possession and carrying of weapons, the authorized persons and the reasons for their use, respectively.
