La investigación tiene como objetivo Elaborar un proyecto de reforma legislativa al Código del Trabajo, que establezca la obligación del empleador de emplear una proporción suficiente de adultos mayores para garantizar el derecho humano a una vida digna. La investigación posee una metodología mixta es decir cualitativa y cuantitativa dado que se realizaron encuestas y entrevistas, obteniendo como resultado que En Ecuador existe un alto porcentaje de personas adultas mayores que se encuentran en posición de desempleo o cesantes y se enfrentan al paradigma de la inserción laboral por parte de las empresas o personas particulares, inclusive hasta en el ámbito del trabajo doméstico, tomando en consideración que con la entrada de vigencia de la Constitución de la República del Ecuador se instituyeron derechos o garantías constitucionales que protegieron a los grupos vulnerables y también a los grupos de minoría, que además de haber sido beneficiados, tanto a nivel constitucional, también lo han sido a nivel legal por lo que urge la práctica o ejecución de estas normas en la sociedad, concluyendo que existe una desprotección laboral del estado hacia los adultos mayores ya que no existe ninguna normativa que obligue a los empleadores a contratarlos, de ahí que los mismos caigan en estado de necesidad producto de la falta de empleo que les ayude a cubrir sus gastos básicos, siendo imperioso reformar el numeral 33 del Art. 42 del Código del Trabajo con el fin de lograr una equidad laboral sin discriminación.
The objective of the investigation is to prepare a legislative reform project to the Labor Code, which establishes the employer's obligation to employ a sufficient proportion of older adults to guarantee the human right to a dignified life. The research has a mixed methodology, that is, qualitative and quantitative since surveys and interviews were carried out, obtaining as a result that In Ecuador there is a high percentage of older adults who are unemployed or unemployed and face the paradigm of labor insertion by companies or individuals, including even in the field of domestic work, taking into consideration that with the entry into force of the Constitution of the Republic of Ecuador, constitutional rights or guarantees were instituted that protected vulnerable groups and also to minority groups, which in addition to having been benefited, both at the constitutional level, have also been benefited at the legal level, which is why the practice or execution of these norms in society is urgent, concluding that there is a lack of state labor protection towards older adults since there is no regulation that obliges employers to control tie them up, hence they fall into a state of need as a result of the lack of employment that helps them cover their basic expenses, it being imperative to reform numeral 33 of Art. 42 of the Labor Code in order to achieve labor equity without discrimination.
