El presente trabajo investigativo tiene como objetivo el desarrollo del tema: dicotomía legal de la potestad disciplinaria del Consejo de la Judicatura; para ello, se analizará la potestad disciplinaria como medio para asegurar la correcta administración de justicia. La Constitución en los artículos 178 y 181 prevé la potestad disciplinaria al reconocer al Consejo de la Judicatura como órgano de vigilancia y disciplina de la Función Judicial, y más específicamente, al dotarle entre sus funciones la dirección de los procesos de sanción. Por ello, surge la necesidad del control de oficio, cuando la denuncia no se materialice. Por lo tanto, bajo dicha potestad, el Consejo de la Judicatura, puede imponer sanciones cuando los servidores judiciales han faltado a los deberes funcionales. Sin embargo, con la exigencia de la declaratoria jurisdiccional previa ante infracciones de dolo y manifiesta negligencia, esto podría convertirse en un obstáculo irrazonable para el ejercicio de la potestad disciplinaria.
The objective of this investigative work is to develop the topic: legal dichotomy of the disciplinary power of the Council of the Judiciary; because of that, the disciplinary power will be analyzed as a means to ensure the correct administration of justice. In the Constitution, in articles 178 and 181, the disciplinary power is determined with the recognition of the Council of the Judiciary as the body of surveillance and discipline of the Judicial Function, and more specifically, by endowing it among its functions and the direction of sanctioning processes. For this reason, the need for ex officio control arises. Therefore, under said authority, the Council of the Judiciary, can impose sanctions when the judicial officials have failed in their functional duties. However, with the requirement of a prior jurisdictional declaration in the event of infractions of malice and gross negligence, this could become an unreasonable obstacle to the exercise of disciplinary powers.
