El rechazo in limine de la demanda es una facultad otorgada al juez para separar del proceso judicial demandas que no solo incumplan con los presupuestos procesales exigidos por la ley sino también aquellas demandas que contienen en su pretensión un objeto jurídicamente imposible y que, al obtener una sentencia, ésta no resolvería el fondo del asunto. Este trabajo desarrolla varios puntos de doctrinarios que aceptan que la figura del rechazo in limine de la demanda se encuentre en los ordenamientos jurídicos; de igual forma, se analiza la posición de aquellos autores que se encuentran en contra de esta posición debido a que este poder del juez puede vulnerar el derecho a la tutela judicial efectiva de los ciudadanos al momento de solicitar amparo jurídico al Estado. Sin embargo, daremos a explicar que el objetivo de esta figura es tratar de descongestionar el sistema judicial eliminando todas aquellas demandas que no nacerían a la vida jurídica sin caer en el extremo de privar de justicia a los ciudadanos.
The in limine rejection of the complaint is a power granted to the judge to separate from the judicial process complaints that not only fail to comply with the procedural requirements required, but also complaints that have an impossible legal object and when obtaining a sentence, this would not resolve the merits of the matter. This work develops various points of doctrine, those that accept the figure of the in lime rejection found in legal systems and the position of those authors who are against this figure. At the same time, the opposite position is analyzed because this power of the judges can violate the rights to an effective judicial protection of the citizens when requesting legal protection from the State. However, we will explain that the objective of this figure is to try to decongest the judicial system by eliminating those complaints that would not be born into a legal life without falling into the extreme of depriving citizens of justice.
