Esta investigación está enfocada en determinar cúal es la necesidad de que se implemente la tenencia compartida en Ecuador, a través de definir los derechos principales de los niños, niñas y adolescentes, y aplicando efectivamente la búsqueda del interés superior del niño sin afectación en el camino, además, se realiza un breve repaso a la legislación de otros países de Latinoamérica y Europa, para observar cómo se maneja el tema en los diferentes países. También se hace un recorrido por los problemas que se pueden desatar con la actual figura de la tenencia exclusiva que se lleva a cabo en nuestro país, como lo es la alienación parental y el quebrantamiento de los vínculos entre padres e hijos. Finalmente se analiza la posible regulación tanto del derecho de visitas, como del derecho de alimentos y a cargo de quién quedarían con la posible implementación de la tenencia compartida.
This research is focused on determining what is the need for shared tenure to be implemented in Ecuador, through determining the main rights of children and adolescents, and protecting the best interest of the child by not affecting it along the way, a brief review of the legislation of other Latin American and European countries is also carried out, to observe how the issue is handled in different countries. There is also a tour of the problems that can be unleashed with the current figure of exclusive ownership that takes place in our country, such as parental alienation and the breaking of the ties between parents and children. Finally, the possible regulation of visitation rights, as well as the right to food and in charge of who would be left with the possible implementation of shared tenure are analyzed.
