Las fuentes del derecho, a lo largo de la historia, han creado teorías y normas que buscan regular y aminorar el desarrollo del abuso del derecho. Este abuso consiste en la extralimitación o desvío de las atribuciones que el derecho otorga. Uno de los escenarios en los que se presenta de forma más común estos actos fraudulentos, es por parte de las sociedades, que, al revestirse detrás de un velo societario, dificulta formar el vínculo con los verdaderos responsables. Aquí es donde entra la figura de un administrador de hecho, aquel que detrás de una persona jurídica, desvía el objeto de la misma para afectar a terceras personas. Como estos perjuicios que se les causa a entes externos deben ser indemnizados, las distintas teorías como las del levantamiento del velo societario o la desestimación de la persona jurídica, les ha dado las facultades a los jueces para que puedan hacer efectiva la justicia. En el año 2012 se promulgó la Ley para la defensa de los Derechos Laboral, la cual pretende definir y regular las actuaciones del abuso del derecho, permitiéndole al estado hacer efectivas las acreencias que tengan con el mismo en los casos de abuso del derecho, creando un inusual privilegio, que le fue denegado a lo acreedores, es decir, al ciudadano común.
The sources of law, throughout history, have created theories and norms that seek to regulate and lessen the development of the abuse of law. This abuse consists of the excess or deviation of the powers granted by the law. One of the scenarios in which these fraudulent acts are most commonly presented it is in the part of the companies, that by putting themselves behind a corporate veil, it complicates the link with the real responsible parties. This is where the figure of a de facto administrator comes in, the one that behind a legal person, diverts the object of the same to affect third parties. These damages caused to external entities must be compensated, the different theories such as the removal of the corporate veil or the dismissal of the legal entity, has given the powers to the judges so that they can enforce justice. In 2012 the Law for the Defense of Labor Rights was enacted, which aims to define and regulate the actions of the abuse of the right, allowing the state to make effective the credits they have with it.
