Description: El propósito del presente trabajo de investigación implica el desarrollo del tema: LA NECESIDAD DE REGULAR LA PRÁCTICA DE LA PRUEBA DOCUMENTAL EN EL CODIGO ORGANICO GENERAL DE PROCESOS, ya que si bien es cierto en el cuerpo normativo mencionado existen disposiciones que regulan el anuncio y la práctica de las pruebas, específicamente la exhibición de las mismas no se encuentra desarrollada. Este vacío legal ha abierto las puertas para que los juzgadores hagan uso de su leal saber y entender, formando su propio criterio de lo que implica exhibir imponiendo en ciertas ocasiones formalidades que la ley no ha previsto, dificultando el actuar de los profesionales del derecho en las audiencias orales.
The purpose of the present research implies the development of the topic: THE NEED TO REGULATE THE PRACTICE OF DOCUMENTARY EVIDENCE IN THE GENERAL ORGANIC CODE OF PROCEDURES, since although it is true that in the mentioned normative body there are dispositions that regulate the announcement and the practice of evidence, specifically the exhibition of the same is not developed. This legal vacuum has opened the doors for the judges to make use of their best knowledge and understanding, forming their own criteria of what it means to exhibit, imposing in certain occasions formalities that the law has not foreseen, making it difficult for the legal professionals to act in the oral hearings.
