El objeto del presente trabajo de titulación es realizar un estudio y análisis sobre las relaciones laborales dentro del mar, las cuales, durante años han sido desatendidas por nuestra normativa ecuatoriana, resignándolas a la aplicación de las mismas normas que las que regulan el trabajo continental. Para ello, comenzaremos analizando las características y peculiaridades del derecho laboral marítimo, identificando las circunstancias diferenciadoras de dicha relación con la relación laboral ordinaria. Posteriormente, estudiaremos las regulaciones internacionales sobre el trabajo marítimo más importantes, encontrándonos con el Convenio sobre el Trabajo Marítimo (2006) emitido por la Organización Internacional de Trabajo. Finalmente, analizaremos la poca normativa laboral marítima que nuestro ordenamiento jurídico desarrolla, estudiando, entre otros, el Acuerdo Ministerial 82 del Ministerio de Trabajo, el cual regula las relaciones dentro de cruceros navegables en Galápagos; y la Resolución del Ministerio de Transporte y Obras Públicas No. SPTMF 041/13, que regula los requisitos que deben tener los trabajadores para laborar dentro de buques y naves afines.
The object of the present titration work is to carry out a study and analysis on labor relations within the sea, which for so many years have been abandoned by our Ecuadorian regulations, resigning them to the application of the same norms as those that regulate continental work. To do this, we will begin by analyzing the characteristics and peculiarities of maritime labor law, identifying the differentiating circumstances of this relationship with the ordinary labor relationship. Later we will study the most important international regulations on maritime work, finding the Convention on Maritime Labor (2006) issued by the International Labor Organization. Finally, we will analyze the little maritime labor regulations that our legal system grants us, studying Ministerial Agreement 82 of the Ministry of Labor, which regulates relations within navigable cruises in Galapagos; and the Resolution of the Ministry of Transport and Public Works, No. SPTMF 041/13, which regulates the requirements that workers must have to work within ships.
