El presente trabajo investigativo se enfoca en la interrupción voluntaria del embarazo y como esta es penalizada dentro del Estado Ecuatoriano. Habla acerca de la inconstitucionalidad del aborto, así como analiza el derecho a la vida dentro de la Constitución. Los artículos 45 de la Constitución de la República del Ecuador y el artículo 150 del Código Orgánico Integral Penal son los que se discuten y analizan para resolver si existiría una eficacia en la despenalización del aborto. Se hace referencia a la sentencia 34-19-IN/21 la cual tiene como tema principal el aborto y resuelve que existe inconstitucionalidad en el artículo 150 del Código Orgánico Integral Penal. De la misma forma se analiza la realidad jurídica y social del Ecuador para llegar a una conclusión que sea beneficiosa para el Ecuador como país y para la mujer como persona sujeta de derechos.
The research paper hereby presented, focuses on the voluntary interruption of pregnancies and how this is punished in Ecuador. It talks about how abortion is a conduct that goes against the Constitution, as well as analyzing the right to life inside the Constitution of the Republic of Ecuador. Article 45 of the Constitution of Ecuador and article 150 of Ecuador’s penal code are the ones that are analyzed and discussed to resolve if there would be effectiveness in the decriminalization of abortion in Ecuador. The Court judgement 34-19-IN/21, which has abortion as its main issue and resolves that there is unconstitutionality in article 150 of the Organic Comprehensive Criminal Code is mentioned. In the same manner, the legal and social reality of Ecuador is analyzed to reach a conclusion that is beneficial for Ecuador as a country and for women in general as people who are subject to rights.
