La presente investigación se enfoca en la ineficacia del derecho a la tutela judicial efectiva y el principio de celeridad frente al derecho alimentario de niños, niñas y adolescentes, que comprende la sustanciación del proceso de alimentos en un tiempo razonable , considerando que las pensiones alimenticias son un derecho de los hijos y un deber de los padres, derecho connatural a la vida, necesario, impostergable e inmediato, que en la práctica cae en letra muerta, razón por la cual se dice que la tutela judicial efectiva que brinda el Estado es ineficaz por los obstáculos que impone el juzgador, concordando su accionar a un retardo injustificado, desconociendo los principios de celeridad y tutela judicial efectiva más aun que se refiere a un reclamo por alimentos, vulnerando el derecho del alimentado de recibir a tiempo el pago por pensiones alimenticias, por ello los jueces deben conducir trámites por vías expeditas.
The present investigation focuses on the ineffectiveness of the right to effective judicial protection and the principle of speed against the right of children and adolescents, which includes the substantiation of the food process in a reasonable time, considering that alimony is a right of the children and a duty of the parents, a connatural right to life, necessary, immaterial and immediate, which in practice falls into a dead letter, which is why it is said that the effective judicial protection provided by the State is ineffective due to the obstacles imposed by the judge, agreeing his actions to an unjustified delay, ignoring the principles of speed and effective judicial protection, even more so that it refers to a claim for food, violating the right of the fed to receive payment for alimony in time That is why judges must conduct procedures through expedited channels.
