El propósito de investigación radica en reflejar la figura jurídica de las capitulaciones matrimoniales, regímenes económicos que se configuran en cada caso, como se maneja la nulidad de este contrato y que procede cuando existe afectación a terceros además del análisis establecido en las normas ecuatorianas correspondientes y colegir algunos casos comparados con legislación internacional. Además, conocer a fondo aquellos requisitos de validez y explorar la inexistencia de estos y qué consecuencias conllevan al momento de no estar expresamente regulados por la normativa correspondiente. La manera es buscar una forma concreta e innovadora de resaltar dichos elementos, características que abarcan los efectos jurídicos de las nulidades en las capitulaciones matrimoniales con referencia a la legislación ecuatoriana. De forma concluyente encontraremos varios puntos para un futuro en la exploración de este tema para que crezca el campo investigativo alrededor de la presente temática de los cuales de manera acertada hallaremos más material académico en nuestra plataforma jurídica.
The purpose of the research is to reflect the legal figure of the marital contracts, economic regimes that are configured in each case about how the nullity of this contract is handled and that proceeds when there is affectation to third parties in addition to the analysis of the established in the corresponding Ecuadorian norms and to collate some cases compared with international legislation. In addition to acknowledging in depth those requirements of validity and exploring the non-existence of the same and what consequences they entail at the time of not being expressly regulated by the corresponding regulations. The way is to look for a concrete and innovative way to highlight those elements, characteristics that cover the legal effects of the nullities in the marriage contracts concerning the Ecuadorian legislation. In conclusion, we will find several points for future exploration of this topic to grow the research field around the present subject of which we will rightly find more academic material in our legal platform.
