La acción afirmativa o también conocida como discriminación positiva, encuentra sus indicios en Estados Unidos, actualmente se emplea como instrumento de protección hacia las personas que pertenecen a los grupos vulnerables que han sido invisibilizados por décadas, aislados por ciertas características como: la etnia al ser indígena, la religión, la calidad de mujer, los discapacitados, entre otras, como consecuencia fueron ignorados por el Estado. Este grupo de personas han soportar malos tratos, el no poder acceder al disfrute pleno de sus derechos como cualquier ser humano e infinidades de situaciones adversas. El Estado a través de políticas públicas, y con un objeto de revertir esta situación, crea diversos programas y beneficios, tratando de esa manera de incluirlos en la vida cotidiana y ser parte del mandato constitucional, con el fin de que accedan en igual proporción a captar el poder, a la satisfacción de sus derechos. El derecho internacional también incluye las acciones afirmativas en su agenda, para conseguir el disfrute pleno de los derechos de los ciudadanos de todos los Estados y especialmente la igualdad formal y material plasmada en las cartas magnas.
The affirmative action or also known as positive discrimination, its indications were in the United States, currently it is used as an instrument of protection towards people who belong to the group of victims, who have been isolated by certain characteristics that they possess, such as being indigenous, their religion, being a woman, disabled, among others, as a result they were separated from others. These people had to endure abuse for many years, such as not being able to access their rights like any human being and countless similar situations. State laws through public policies created various benefits for the injured, thus including them in everyday life and being part of the mandate, with the purpose of eliminating the feeling of inferiority compared to others and access their rights equally, under the protection of constitutional norms. International laws have also spread using resources such as campaigns, organizations, and their message of equality in all their presentations
