El presente trabajo constituye el resultado de un estudio con el propósito de entender el rol del juez como mediador en la solución de conflictos según el COGEP. Cuando se estudia el rol del juez debe considerarse principios, derechos y garantías constitucionales que deben ser cumplidas en la administración de justicia, especialmente cuando la naturaleza de la jurisdicción facilita a los administradores de justicia para que cumplan con lo estipulado en la Carta Magna. Para la elaboración de esta investigación de desarrollo primeramente un capítulo teórico en el cual se dan cuenta los conceptos fundamentales para entender el papel de mediador del juez; tal capítulo contiene también un estudio de derecho comparado. Luego la investigación plasma las entrevistas a los expertos en materia de derecho procesal civil en cuanto a su postura con respecto al rol del juez; y por último, y como consecuencia de todo lo anterior, se formula una propuesta de reforma legal para darle mayor viabilidad al rol del juez y del notario
The present work is the result of a study with the purpose of understanding the role of the judge as a mediator in the solution of conflicts according to the COGEP. When studying the role of the judge should be considered principles, rights and constitutional guarantees that must be met in the administration of justice, especially when the nature of the jurisdiction facilitates the administrators of justice to comply with the provisions of the Magna Carta. For the elaboration of this development research, first a theoretical chapter in which the fundamental concepts are realized to understand the role of mediator of the judge; such chapter also contains a study of comparative law. Then the investigation captures the interviews with the experts in civil procedural law regarding their position regarding the role of the judge; and finally, and as a consequence of all of the above, a legal reform proposal is formulated to give greater viability to the role of the judge and the notary
