Si bien Ecuador ha firmado tratados internacionales de cooperación entre países para garantizar una protección efectiva de los derechos de los menores, existen barreras que dificultan el acceso a la manutención cuando el deudor radica en el extranjero. El presente trabajo analiza las fallas existentes en la ley actual, con el propósito de obtener una mejora en la ejecución de pagos de pensiones alimenticias en el extranjero, garantizando así la protección del derecho inherente e irrevocable a alimentos del niño, niña y adolescente, precautelando el interés superior del menor. De esta manera surgen varias interrogantes, ¿Cómo se puede mejorar el procedimiento actual para el cobro de dichos alimentos? ¿Existen suficientes recursos para una efectiva colaboración entre estados en estos casos? Y, por último, ¿Se le da la suficiente relevancia a este tipo de requerimientos?
Although Ecuador has signed International Treaties of cooperation between countries to ensure an effective protection of minor’s rights, there are barriers that make it difficult to access to maintenance when the obligor is abroad. The present work analyzes the existing faults in the current law, with the purpose of obtaining an improvement in the execution of alimony payments abroad, guaranteeing in this way the protection of the inherent and irrevocable right of child support in line with the best interests of children. In this way, several questions arise. How can the current procedure for alimony payments be improved? Are there the necessary resources for an effective collaboration between countries in these cases? And finally, are these kinds of requirements given enough relevance?
