Dentro del presente trabajo se pretende abordar un análisis jurídico respecto a la inclusión del contrato de hipoteca, y por ende la hipoteca abierta, en la categoría de títulos de ejecución, en la reforma al Código Orgánico General de Procesos del 26 de junio del 2019. En el primer capítulo, realizaremos un breve recorrido de los antecedentes históricos que otorgan la naturaleza jurídica de la hipoteca, y un análisis de su definición, características esenciales y los derechos que otorga este contrato, a fin de entender la importancia de la hipoteca como garantía en nuestra sociedad; luego como corresponde, examinaremos la hipoteca abierta, su definición, implementación en nuestro ordenamiento jurídico y su respectiva ejecución. A continuación, en el segundo capítulo, revisaremos cómo funciona el procedimiento de ejecución hipotecaria en el ordenamiento jurídico del Ecuador y el Dictamen Constitucional No. GO3-19-DOP-C que aprobó al contrato de hipoteca como título de ejecución, para finalmente tomar una postura frente al problema jurídico planteado y realizar las respectivas conclusiones y recomendaciones.
The present work intends to address a legal analysis regarding the inclusion of the mortgage contract, and therefore the open mortgage, in the category of titles of execution, in the reform to the General Organic Code of Processes of June 26, 2019. In the first chapter, we provide a brief overview of the historical background that gives the legal nature of the mortgage, and an analysis of its definition, essential characteristics and the rights granted by this contract, in order to understand the importance of the mortgage as a guarantee in our society; then, as appropriate, we examine the open mortgage, its definition, implementation in our legal system and its respective execution. Next, in the second chapter, we will review how the mortgage foreclosure procedure works in Ecuador's legal system and Constitutional Opinion No. GO3-19-DOP-C that approved the mortgage contract as a title of foreclosure, to finally take a position on the legal problem raised and make the respective conclusions and recommendations.
