El presente trabajo tiene como objetivo realizar un análisis sobre hasta qué punto nuestro ordenamiento jurídico, siendo especifico la Constitución y tratados internacionales, defienden y respetan los derechos humanos y constitucionales de los inmigrantes en el Ecuador. La movilidad humana es un nuevo concepto que se introdujo en la Constitución del 2008, constituye un gran avance en materia de derechos humanos, por lo que el trabajo trata principalmente sobre temas como no considerar ilegales a las personas por su condición migratoria, la no discriminación, la ciudadanía mundial, la no restricción a la libertad de tránsito, la igualdad de derechos tanto para nacionales como para extranjeros, un análisis que propone lo que se debería tomar en cuenta para establecer requisitos o soluciones eficaces para la problemática en la que nos encontramos envueltos hoy en día. Para ello he revisado cuerpos jurídicos como la Constitución de la República, la Ley Orgánica de Movilidad Humana y los tratados internacionales suscritos por el Ecuador.
The objective of this paper is to analyze the extent to which our legal system, being specific to the Constitution and international treaties, defends and respects the human and constitutional rights of immigrants in Ecuador. Human mobility is a new concept that was introduced in the Constitution of 2008, is a breakthrough in human rights, so the work mainly deals with issues such as not consider illegal people because of their immigration status, non-discrimination , the world citizenship, the no restriction to the freedom of transit, the equality of rights for both nationals and foreigners, an analysis that proposes what should be taken into account to establish requirements or effective solutions for the problem in which we find ourselves wrapped today. For this I have reviewed legal bodies such as the Constitution of the Republic, the Organic Law of Human Mobility and international treaties signed by Ecuador.
