El presente trabajo, se basa en virtud del principio de reformatio in peius, mismo que se encuentra presente en nuestra Constitución, de vital importancia procesal, por cuanto el mismo garantiza a las partes procesales la prohibición de reformar en peor, a la parte recurrente. Se analizará la institución jurídica desde el momento en que se originó, hasta los actuales momentos, en Ecuador. Además veremos como el principio reformatio in peius es tratado primero solo en aspectos de materia penal solamente, y, a continuación trataremos el tema de cómo se implementó este principio a todas las ramas del derecho, esto es, al ámbito administrativo, civil, constitucional, entre otras cosas. Por último se analizará el principio en virtud del derecho comparado, y, como el mismo es tratado en diferentes países, y cada uno de sus aspectos, como sus limitantes, y por último concluiremos analizando el principio y como mejorar el principio en ciertos aspectos procesales.
The present work is based on the principle of reformatio in peius, same that is present in our Constitution, of vital procedural importance, because it guarantees the procedural parties the prohibition to reform in worse, the appellant. The legal institution will be analyzed from the moment it originated, until now, in Ecuador. In addition, we will see how the principle reformatio en peío it has been treated, first, in aspects of matter of criminal matters only, and next, we will deal with the issue of how this principle is implemented to all the branches of law, that is, to the administrative, civil, constitutional, among other things. Finally, it will be analyzed the principle under comparative law, and, how is treated in different countries, and each of its aspects, as its limits, and by the last, will conclude by analyzing the principle and how to improve the principle in certain procedural aspects.
