The purpose of this study is to raise awareness and discern the institution of commercial trust, from its origins to identify with their applicable legislation, seeking to highlight its practical usefulness, so that this legal institution to diffuse into potential users. Looking for the purpose raised in this study, we tried to create a query tool that allows the reader to identify with this institution of law which is simple in structure, and broad objectives. Since the commercial trust, unlike the civil trust, is in our legislation an institution recently created, we must make as contribution necessary to give the importance that their special characteristics deserve, so that by its various uses, it identified as a business tool, or as .seguros investment mechanisms, guarantee, project development, or others. Finally, we seek to achieve the purposes of this study, based on a deep doctrinal, legal and their analysis study as well as on the development of practical examples that reflect new trends in the use of commercial trust, applied to everyday situations the world today, so that we obtain the desired conclusions, in which we expressly confirm those advantages and functionality as the commercial trust contributes to our national reality.
La finalidad del presente estudio, consiste en dar a conocer y discernir la institución del fideicomiso mercantil, desde sus orígenes, hasta identificarnos con su legislación aplicable, buscando resaltar su utilidad práctica, de manera que esta institución jurídica se difunda dentro de sus potenciales usuarios. Buscando la finalidad planteada en este estudio, intentamos crear una herramienta de consulta, que permita al lector identificarse con esta institución de derecho la cual es de sencilla estructura, y de amplios objetivos. Puesto que el fideicomiso mercantil, a diferencia del fideicomiso civil, es en nuestra legislación una institución de reciente creación, debemos efectuar cuanto aporte sea necesario, para darle la trascendencia que por sus características especiales merece, de manera que por sus diversos usos, se lo identifique como una herramienta de negocios, o como mecanismos .seguros de inversión, de garantía, de desarrollo de proyectos, u otros. Por último, buscamos lograr las finalidades de este estudio, sobre la base de un profundo estudio doctrinal, legal y su correspondiente análisis, así como sobre la elaboración de ejemplos prácticos que reflejen las nuevas tendencias de uso del fideicomiso mercantil, aplicadas a las situaciones cotidianas del mundo actual, de manera que obtengamos las conclusiones deseadas, en las cuales de manera expresa podamos constatar aquellas ventajas y funcionalidad que el fideicomiso mercantil aporta a nuestra realidad nacional.
