El ejercicio del derecho constitucional a la educación superior, a la luz del actual sistema nacional de nivelación y admisión a las instituciones de educación superior

In Ecuador, from the year 2012 was implemented a new National System of Leveling and Admission to the public universities and polytechnics, which the propose of this research wok was to investigate specific aspects of this process, as well as emphasize the fundamental duty that has the state of which its actions are routed to the protection of the rights recognized in the Constitution without any discrimination and to guarantee the effective use of the same ones. This thesis analyzes an infringement to right of the applicants such as access to higher education derivate from the current system previously mentioned. At the completion of the work are guidelines of legal solution in which it is carried out a reform to a specific article to the regulation of the national system of leveling and admission (SNNA) in which it decided according to this research that was restricting the right previously mentioned as well does the same exposed emphasis on the national reality concerning basic education and high school which is decisive at the time of application to higher education.
En el Ecuador a partir del año 2012 se implementó un nuevo Sistema Nacional de Nivelación y Admisión a las Universidades Públicas y Escuelas Politécnicas del país, por lo cual la finalidad de este trabajo de investigación fue indagar aspectos específicos de este proceso, así como recalcar el deber fundamental que tiene el Estado de que sus acciones se encaminen a la protección de los derechos reconocidos en la Constitución sin ninguna discriminación y garantizar el goce efectivo de los mismos. La presente tesis determina que tal sistema se opone a la vigencia del derecho fundamental de acceder a la educación superior en igualdad de oportunidades. A la finalización del trabajo se encuentran lineamientos de solución jurídica en el cual se propone una reforma a un artículo concreto al Reglamento del Sistema Nacional de Nivelación y Admisión - SNNA, en el cual se encontró, según esta investigación que restringía el derecho anteriormente expuesto, así mismo hace énfasis en la realidad nacional respecto de la educación básica y de bachillerato la cual es determinante al momento de postularse a la educación superior.
