The main objective of this titling work is to demonstrate the unconstitutionality of the article 340 of the General Organic Code of Processes, because it limits the exercise of the right of free access to justice. Since the referring of these cases to a notary competence, the exercise of the right has been limited to the payment of a notarial fee, which generates the transgression to the right of the free access to justice. Evidently the provisions contained in article 340 of the General Organic Code of Processes, are not compatible with the Constitution, and therefore not only violates the elements of the fundamental core of the right that lies in the gratuity, these provisions also violate the specifics and application principles that govern this constitutional right.
El presente trabajo de titulación tiene el objetivo principal demostrar que el artículo 340 del Código Orgánico General de Procesos es inconstitucional, debido a que limita el ejercicio del derecho de acceso gratuito a la justicia, pues al remitir estos casos a la competencia del notario, se condiciona el ejercicio del derecho, al pago de una tasa notarial, por lo que evidentemente las disposiciones contenidas en el artículo 340 del COGEP, no son compatibles con la Constitución, y por tanto no solo vulnera uno de los elementos del núcleo fundamental del derecho que recae en la gratuidad, sino también vulnera ciertos principios específicos y de aplicación que rigen a este derecho constitucional.
