The present thesis describes the principal characteristics of the “Estado Constitucional de derechos y justicia”, stipulated in the 2008 Ecuadorian Constitution, and establishes the evolution or involution produced, based on the 1998 Ecuadorian Constitution. This new paradigm considers that human rights have the same range; as a consequence, for its application a ponderation judgment is needed. This type of judgment is the new constitutional interpretation mechanism, which is made by the Corte Constitucional and not by the legislators as usual. Differences between the material and the legalist state are established; the new jurisdictional, non jurisdictional and normative guaranties are described, and the institutions in charge to fulfill the accomplishment of the Constitution are analyzed.
La presente tesis tiene la finalidad de exponer las características principales del estado constitucional de derechos y justicia estipulado en la Constitución de 2008, y establecer la evolución o involución producida con respecto al Estado Social de derecho de la constitución de 1998. Este nuevo paradigma, considera a los derechos de igual jerarquía; como consecuencia, para su aplicación inmediata se debe realizar un juicio de ponderación, el cual, es el nuevo mecanismo de interpretación de la Constitución. Ésta interpretación, ya no está a cargo de los legisladores, sino de la nueva Corte Constitucional, eje de control del constitucionalismo ecuatoriano…
