The present work “Las Garantías Constitucionales en el Ecuador” concentrates on the analysis of the constitutional guarantees like mechanisms of protection of the rights established in the Constitution of the Republic of Ecuador. The Statutory law of Constitutional Guarantees and Constitutional Control promotes the regulation of the jurisdictional guarantees, also establishes the procedural principles, the proceeding, the tests and all directed norm to regulate these guarantees as they are: the Protection action, the Habeas Corpus, the access Action to the public information, the Habeas Data, and the extraordinary Protection. Chapter one defines Neoconstitutionalism, its historical facts and a description about some types of democracy. In chapter two, the historical antecedents and the artificial nature of the constitutional guarantees are analyzed. Chapter three carries out a comparative study of the constitutions of the years 1998 and 2008. In chapter four the jurisdictional guarantees are analyzed.
El presente trabajo "Las Garantías Constitucionales en el Ecuador" se centra y se basa en el análisis de las Garantías Constitucionales como Mecanismos de Protección de los Derechos establecidos en la Constitución de la República del Ecuador. Actualmente el uso de estas herramientas jurídicas se ha convertido en un verdadero desafío para toda la sociedad, debido a la importancia que ha ganado este campo dentro del derecho, el legislador ha puesto especial énfasis en promulgar una ley especial que regule a las Garantías Constitucionales o las llamadas Garantías Jurisdiccionales específicamente en la actualidad. Esta Ley se la denominó Ley Orgánica de Garantías Constitucionales y Control Constitucional, y promueve la regulación de las Garantías Jurisdiccionales mediante un articulado que establece los Principios Procesales, el Trámite, las Pruebas y toda herramienta encaminada a normar y regular estas Garantías como son La Acción de protección, La Acción de Habeas Corpus, La Acción de Acceso a la Información Pública, La Acción de Habeas Data, La Acción Extraordinaria de Protección y Las Medidas Cautelares…
