La regulación de la figura de testigo hostil en el sistema dispositivo ecuatoriano

The hostile witness figure is an important tool within every adversarial procedural system. Given that Ecuador currently counts with a dispositive procedural system, this figure could play a relevant role inside every procedure. Nonetheless, the Organic Integral Penal Code, normative body of exclusive penal character, consecrates it, causing a series of practical disadvantages. On the other hand, the General Organic Procedural Code, normative body recently implemented, establishes the existence of the hostile witness figure, but in an inadequate manner. Therefore, it is pertinent to define this figure and analyze it in these normative bodies, in order to observe the repercussions caused by its omission and inadequate regulation.
La figura de testigo hostil es una herramienta importante dentro de todo sistema procesal adversarial. Dado que el Ecuador actualmente cuenta con un sistema procesal dispositivo, esta figura podría jugar un rol relevante dentro de cada procedimiento. Sin embargo, en el Código Orgánico Integral Penal, cuerpo normativo de carácter exclusivamente penal no se la consagra, causando una serie de inconvenientes prácticos. Por otro lado, el Código Orgánico General de Procesos, cuerpo normativo recientemente implementado, establece la existencia de la figura de testigo hostil, pero de una manera inadecuada. En tal virtud, resulta pertinente definir a esta figura y analizarla en cada uno de estos cuerpos normativos, a fin de observar las repercusiones que causa su omisión e inadecuada regulación.
