The study of effective penalties for the offense of unlawful trafficking of patrimony assets is approached from the doctrinal aspect, starting with the study of criminality, continuing an extensive analysis of the cultural heritage elements, classifications, and importance; to finally get to delve into what illicit trafficking in cultural property is. In the second part of this work the topic is addressed from a legal and constitutional point of view, where an investigation of existing standards was made on the legal-juridical context about the smuggling of assets, as well as the institutions involved in the fight against the analyzed crime, one of the most important points in this chapter is the breakdown of each of the elements of the offense under OIPC (Organic Integral Penal Code) as illicit transportation and trading and smuggling of cultural heritage assets. Regarding the research methodology applied in this titling work, it was decided to conduct polls in order to examine through the different social actors, their knowledge about crime, related rules and institutions; and also the analysis of a court case obtaining as results clear reflections of the incessant problems that exist regarding the punishment of this crime is included….
El estudio de la efectiva punibilidad del delito de tráfico ilícito de bienes patrimoniales, es abordado desde el aspecto doctrinario, iniciando por el estudio de la punibilidad, continuando con un vasto análisis sobre el patrimonio cultural, elementos, clasificaciones, importancia; para finalmente llegar a profundizar en lo que consiste el tráfico ilícito de bienes culturales. En la segunda parte de este trabajo la temática es abordada desde el punto de vista legal y constitucional, donde se realizó una indagación de las normas existentes respecto del contexto jurídico-legal del tráfico ilícito de bienes patrimoniales, así como también de las instituciones involucradas en la lucha contra el delito analizado, uno de los puntos más importantes en este capítulo es el desglose de cada uno de los elementos constitutivos del delito tipificado en el COIP, como transporte y comercialización ilícitos y tráfico de bienes del patrimonio cultural. En cuanto a la metodología de la investigación aplicada en este trabajo de titulación se optó por la aplicación de encuestas, con el fin de examinar por medio de los distintos actores sociales, el conocimiento sobre el delito, las normas e instituciones relacionadas….
