Through this research we have conducted a doctrinal and legal study of the Constitution of the Republic of Ecuador, 2008, as relates to the legal provisions of the Fourth Section, Culture and Science, that is, an analysis in order to know and make known our history, our culture, describe and disseminate the cultural expressions of our territory, highlighting the great heritage that has our Ecuador. The Cultural Heritage Act, concerning how precutelar the cultural legacy of our ancestors and the remarkable creations of contemporary art, the protection and maintenance of architectural heritage. This content and legal doctrine is applied as field research in Canton "San José de Chimborazo", a city with a rich culture with historical significance in terms of tangible and intangible assets that are worthy of being described in order that an assessment of the context is made, taking as a fundamental aspect or cultural reference architecture heritage that owns this town, and it is necessary and indispensable research, conserve, preserve, restore, protect and promote in order to not disappear, since which is part of the National Heritage. There has been a description and analysis of the architectural heritage, in order to make known from the legal point of view, it is the duty of the State to preserve the cultural heritage of peoples, because there expressions, values and thinking are synthesized culture of human beings, but when these are anonymous lose their content and value. Chimbo Being one of the first cities or seat of the Spanish foundation, besides having a great influence of the mother country as far as culture is concerned, also certain traditions and customs are observed, especially with the historical-culture of past generations and have been considered in this investigation. 11 Finally it is pointed out how all this legal and historical study allows or helps to strengthen the identity of the citizens of Canton Chimborazo, so that they feel proud of their past and thus can project future under the socio-cultural development.
Mediante la presente investigación hemos realizado un estudio doctrinario y jurídico de la Constitución de la República del Ecuador 2008, en lo que tiene relación a las disposiciones jurídicas de la Sección Cuarta, Cultura y Ciencia, es decir, un análisis con el fin de conocer y dar a conocer nuestra historia, nuestra cultura, describir y difundir las expresiones culturales de nuestro territorio, poniendo de manifiesto el gran Patrimonio que tiene nuestro Ecuador. La Ley de Patrimonio Cultural, en relación a como precautelar el legado cultural de nuestros antepasados y las creaciones notables del arte contemporáneo, la protección y mantenimiento del Patrimonio arquitectónico. Este contenido jurídico y doctrinario se aplica como investigación de campo en el Cantón “San José de Chimbo”, una ciudad con una gran riqueza cultural, con trascendencia histórica en cuanto a los bienes tangibles e intangibles que son dignos de ser descritos, con el fin de que se realice una valoración del contexto, tomando como aspecto fundamental o referente cultural el Patrimonio Arquitectónico que posee esta localidad, y que es necesario e indispensable investigar, conservar, preservar, restaurar, proteger y promocionar con el fin de que no desaparezca, puesto que constituye parte del Patrimonio Nacional. Se ha realizado una descripción y análisis del patrimonio arquitectónico, con el fin de dar a conocer desde el punto de vista jurídico, que es deber del Estado conservar el Patrimonio Cultural de los pueblos, porque ahí se sintetizan las expresiones, los valores y el pensamiento cultural de los seres humanos, pero cuando estos permanecen en el anonimato pierden su contenido y valor. Al ser Chimbo una de las primeras ciudades o asiento de la fundación española, a más de tener una gran influencia de la Madre Patria en lo que a la cultura se refiere, también se observan ciertas tradiciones y costumbres, sobre todo con el legado histórico-cultural de generaciones pasadas y que se han considerado dentro de la presente investigación. 9 Finalmente se puntualiza de qué manera, todo este estudio jurídico e histórico permite o ayuda a fortalecer la identidad de los habitantes del Cantón Chimbo, con el fin de que se sientan orgullos de su pasado y de esta manera se pueda proyectar a futuro en el marco del desarrollo socio-cultural.
