The current plan of Grade’s Project of the APPLICATION OF SYSTEM OF WITNESS PROTECTION, will realize in Otavalo city. This topic gets importance with the reform in Criminal System and Procedural, it ensured for Constitution of year 2008, holding like main tool the system of victim and witness protection. Over that precedent, in 2007 there was a multiple killing at Ranch called “Campo Serio”, it located in San Francisco community, Selva Alegre parish, Otavalo canton, where there was a witness, who was the only survivor. This witness was received to system of victim and witness protection of Imbabura County, because he was afraid today posible attacks against him physical, psychological and moral integrity. His testimony was basic to explain the events and to identic ate to the authors of crime. Therefore, it will study the viability and feasibility of the foundation of a Center of Witness Protection in Otavalo city; this will help to better the application, efficiency and celerity of the criminal process. The current Grade’s Project has a finality of investigate the application of System of Witness Protection through bibliographic roots, legislation, doctrine, compared right, interviews and internet, to diffuse brightly this unknown information in Otavalo canton. In the investigation project the positive impacts waited to have are: social, juristic and politic. The Grade’s Project is structured by five phases, like: the investigation, the develop of Theoretic Frame, of Diagnostic, the Methodology, the analysis of practical expedient and verification of impacts waited. In that Project will use the method bibliographic, historic, analytic -deductive and the comparative. The techniques will use are: the observation, the interview and the research.
El presente plan de proyecto de grado cuyo tema es la APLICACIÓN DEL SISTEMA DE PROTECCION A TESTIGOS se realizará en el Cantón Otavalo. Este tema toma su relevancia por la reforma del sistema penal y procesal penal, garantizado por la Constitución de la República del Ecuador expedida en el año 2008, teniendo como herramienta principal el Sistema de Protección a Víctimas y Testigos. Con este antecedente, en el año 2007 se produce un asesinato múltiple en la Hacienda Campo Serio, ubicada en la comunidad San Francisco, parroquia Selva Alegre, cantón Otavalo, provincia de Imbabura, en el cual existió un sobreviviente quien denuncia lo ocurrido ante la Fiscalía de Imbabura, Cantón Otavalo, mismo que voluntariamente se acogió al Sistema de Protección a Testigos de la Provincia de Imbabura constituyéndose como pieza fundamental para esclarecer los hechos, identificar a los autores, y por temor a posibles atentados contra de su integridad física, psicológica y moral y de su familia. El presente Proyecto de Grado tiene la finalidad de investigar la aplicación del Sistema de Protección a Testigos dentro del proceso penal mediante fuentes bibliográficas, legislación, doctrina, jurisprudencia, derecho comparado, entrevistas e internet, para difundir con claridad esta información desconocida en el cantón Otavalo. Por lo que, se estudiará la vialidad y factibilidad de la creación de un Centro de Protección a Testigos en el Cantón Otavalo, que ayudará a mejorar su aplicación y eficiencia y celeridad dentro de los procesos penales. En el Proyecto de Investigación los impactos positivos que se esperan obtener son: el social, el jurídico y el político. El Proyecto de Grado estará estructurado por cinco fases, de la siguiente manera: la investigación, el desarrollo de Marco Teórico, del Diagnóstico, la Metodología, el análisis del caso práctico y la verificación de impactos esperados. En dicho proyecto se utilizará el método bibliográfico, histórico, analítico-sintético; inductivo-deductivo y el comparativo. Las técnicas que se usarán son: la observación, y la entrevista.
