At the beginning of the 19th century, when animal protectionism started, a great debate sparked in society based on whether animals should have rights or protect their welfare through laws, taking on account that the main idea of this debate was based on protecting the most important interests of non-human species. My position in this debate is in support of the legal welfarism, assuming that the life of an animal has inherent value which should be protected through the legal recognition of how important is to take care of its welfare. The difference between species is not one of distinct categories, but merely one of degree. There is nothing in this degree of difference that is so great as to justify the domination visited by our species upon other species of this planet.
A partir del surgimiento del proteccionismo animal originado en el siglo XIX, se han creado dos posiciones al respecto, la primera relacionada con los derechos de los animales y la segunda referida a la protección jurídica del bienestar animal. Acogiendo esta última posición sobre la protección jurídica que le merece el bienestar animal, la tesina analiza varios aspectos relacionados con el tema, partiendo del hecho que los seres humanos no tienen características diferentes que los hagan superiores o les den la potestad de dominar sobre los animales. Por esta razón la investigación sostiene, que es indispensable aplicar el principio de igualdad en la consideración que los animales deben recibir como un deber u obligación que tienen los seres humanos para con los animales.
