Contexto de violencia armada en México : una lectura desde el derecho internacional humanitario y la "responsabilidad de proteger"

“War” is the term used by the Mexican government to refer to its confrontation against the drug criminal groups. This term hides a deeper meaning than the official rhetoric could suggest in a context where those groups wield economic interest rather than political ideologies to confront the State. The present study wants to give an answer to the question, what standards of the International Humanitarian Law are applicable to the new Non-international Armed Conflicts? In the same way, this work tries to establish the International Humanitarian Law as main piece to make effective the “Responsibility to Protect” doctrine wielded by the United Nations in a context where the armed conflicts’ common definitions are no longer useful. However, the interest of this work is not only show the efficiency of the IHL’s standards and their utility to support the “Responsibility to Protect”, but establish the functionality of these legal and doctrinal frames in a context as real and dangerous as the Mexican situation.
El término “guerra” usado por el gobierno mexicano para referirse a la lucha emprendida contra las organizaciones narcotraficantes esconde un significado que escapa a la simple retórica en un conflicto donde los grupos armados no esgrimen valores políticos, sino intereses económico-criminales a la hora de enfrentarse contra el Estado. El presente trabajo busca responder a la pregunta ¿Qué estándares del Derecho Internacional Humanitario son aplicables a los nuevos Conflictos Armados No internacionales? De la misma manera, se intenta establecer al Derecho Internacional Humanitario como una pieza fundamental a la hora de hacer efectiva la doctrina de la “Responsabilidad de Proteger” esgrimida por las Naciones Unidas en un contexto que escapa a las definiciones tradicionales de “conflicto armado”. Sin embargo, el interés de este estudio no es solo demostrar la eficiencia de los estándares contenidos en los instrumentos del DIH y su funcionalidad dentro de la “Responsabilidad de Proteger”, sino establecer la funcionalidad de dichos marcos jurídicos y doctrinarios en un contexto tan real y peligroso como lo es la situación de violencia armada generalizada en México.
