Recently there has been a great amount of research to find alternative mecanisms in order to fight corruption, impunity and other crimes. United States of America and Australia, have created the Whistleblowers Act, and Perú emitted the Ley de Colaboración Eficaz. In this thesis, I present as an alternative mecanism to fight corrupction, impunity and other crimes, the Ley de Protección al Informante Cívico, in Ecuador. Since it is a Constitutional duty and responsability for citizens to report acts of corruption, the objective of this Law is to encourage every citizen to do this when they have knowledge of any of these crimes. The law also establishes different types of responsability, how and where to press charges, the warranties and benefits of the law, and the protection it gives. After analyzing and studying the different mecanisms used to prevent and control corruption, impunity and other crimes, I have concluded that the usage of the Ley de Protección al Informante Cívico, through its benefits and protections, will help citizens to be conscious and carry out their constitutional duty.
En el último tiempo se han buscado mecanismos alternativos para combatir la corrupción, la impunidad y otros delitos. Estados Unidos y Australia promulgaron el Whistleblowers Act, y Perú la Ley de Colabiración Eficaz. En esta tesina, presento como mecanismo alternativo de lucha anticorrupción, antiimpunidad y antidelitos, el Proyecto de Ley de Protección al Informante Cívico en el Ecuador. La Ley de Protección al Informante Cívico, busca motivar a que la ciudadanía realice las denuncias correspondientes, para la debida investigacion del delito y sanción del responsable. El incentivo que presenta le ley se da a través de distintos parámetros que se establecen dependiendo de la responsabilidad del informante cívico. Las denuncias serán hechas ante la autoridad competente para que lleve el proceso y otorge el correspondiente beneficio y analice el debido incentivo. De igual forma, establece las debidas protecciones para el informante cívico y los requerimientos para su calificación. Con los beneficios e incentivos que la ley promueve, las personas empezarán a concientizar y cumplir con su deber constitucional. La adecuada protección, el reconocimiento público y la re-evaluación de la pena, serán incentivos adecuados para iniciar una verdadera y viable lucha contra estos delitos impunes.
