Description: The present disertation deals with the ordeal that Miss Manuela Lavinas Picq had to go through as a foreigner with dual nationality at the moment of her stay in Ecuador. Her partner is a political leader who belongs to the government`s opposition party. She tried to obtain through all thepossible legal means and legal authorities a regular stay in Ecuador. Due to this a whole country will realize the existing loopholes in the Penal Code, and the lack of guarantees that state provides to national and foreign citizens. There refore it is important to propose improvements at the legal and institutional level, including those who are responsable for the respect and guaratee of all rights within the country.
El presente trabajo trata sobre la odisea que tuvo que pasar Manuela Lavinas Picq, extranjera de doble nacionalidad. Mujer conviviente de un líder político, perteneciente a la oposición al gobierno. La cual trata por todas las instancias legales permanecer de manera regular en el Ecuador. Gracias a esto todo un país se dará cuenta de los vacíos legales existentes en su Código Penal y la falta de garantías que presta el estado a ciudadanos nacionales y extranjeros. Por ello se trata de proponer mejoras en el nivel judicial e institucional de los garantes de derecho en el país.
