Compartición de infraestructura : Una nueva figura dentro de la regulación en materia de telecomunicaciones y su incidencia en la generación de libre competencia en el sector

The absence of a clear regulation on the access and use of infrastructure necessary for the rendering of services of telecommunications has generated many disadvantages. For example, nowadays, the use and access to the infrastructure is given by means of private agreements or contracts of lease, agreements plenty of inequitable conditions. The property of necessary infrastructure to give services of telecommunications has turned into an advantage on the operators who lack it. Not to be able to accede to the above mentioned infrastructure generates barriers of entry to the market of some operators who cannot offer their services; putting in danger the generation of free competition in the market. The “share of infrastructure contract” constitutes a figure in which the access and use of the infrastructure of property of another person, already an operator of services of telecommunications or not, are regulated, so they don’t become a limitation for the free competition but a tool that contributes to generate it.
La ausencia de una regulación clara sobre el acceso y uso de infraestructura necesaria para la prestación de servicios de telecomunicaciones por parte de operadores que carecen de alguno de los elementos infraestructurales, ha generado un sin número de inconvenientes. Por ejemplo, en la actualidad, el uso y acceso a la infraestructura se da mediante acuerdos privados o contratos de arrendamiento, acuerdos en los que priman las condiciones inequitativas. La propiedad de infraestructura necesaria para prestar servicios de telecomunicaciones se ha convertido en una ventaja sobre los operadores que carecen de ella, y el no poder acceder a dicha infraestructura genera barreras de entrada al mercado de estos operadores quienes no pueden ofertar sus servicios; poniendo en peligro la generación de libre competencia en el sector. La compartición de infraestructura constituye una figura en la que el acceso y uso de la infraestructura de propiedad de otra persona, ya sea este un operador de servicios de telecomunicaciones o no, se encuentran regulados, de manera que no sean una limitación para la libre competencia sino una herramienta que contribuya a su generación.
