This thesis is developed on the basis of the recall referendum figure present in the Constitution adopted in 2008. We start the analysis of very interesting topics such as gender and regulatory context in which today handles the recall figure. We will observe the principle which inspires the figure, the principle of popular sovereignty, a principle of great importance to understand what really is the spirit of the rule which implements the figure of the recall. For that reason, its necessary to undertake a historical overview of the rules that contain in a certain way the some embodiments of the figure. Similarly, and based on the guiding principle we have a brief historical presentation of the figure treatment, from the beginning until its legal expression in figures of direct democracy. In order to understand the figure we will use a presentation of the recall in other legislations in the region as Colombia, Venezuela and Bolivia. Following that path eventually to the conclusions of why the revocation of the mandate is a power control mechanism and popular sovereignty tool to be kept by the people.
Esta tesina se desarrolla sobre la base de la figura de revocatoria del mandato presente en el Constitución aprobada en 2008. Se parte el análisis de temáticas muy interesantes como el contexto normativo que generó y en el que se maneja hoy por hoy la revocatoria del mandato. Se observara el principio inspirador de la figura el cual es el principio de soberanía popular, principio de mucha importancia para entender cual realmente es el espíritu de la norma que implementa la figura de la revocatoria. Para aquel motivo se realizará una reseña histórica sobre las normas que de cierta forma contenían o realizaban mención a la figura de la revocatoria. De igual manera y sobre la base del principio inspirador se realizará una breve presentación histórica del tratamiento del principio hasta su expresión legal en figuras de la democracia directa. Con el fin de entender la figura se realizará una presentación de la misma en otras legislaciones de la región tal y como lo son Colombia, Venezuela y Bolivia. Siguiendo ese camino finalmente se concluirá el porqué la revocatoria del mandato es un mecanismo de control al poder y soberanía popular.
