This dissertation has the objective of publicize the crime of inverse rape. This occurs when a woman forces a man to penetrate her, or when without the man’s consent she penetrates his penis. In the crime of inverse rape, the legally protected interest is the sexual freedom of each individual, in this case the man's sexual freedom. This matter has not yet being typified by any criminal law in Ecuador, which leaves open the possibility that a woman involved in this crime will never receive a punishment. That is the reason which enhances the need to establish and incorporate into our legal system such crime, which in our country has been completely ignored and is now an important social problem.
Esta tesina tiene por finalidad, dar a conocer sobre el delito de violación inversa, el mismo que se produce cuando una mujer obliga a un hombre a accederla carnalmente o cuando sin su consentimiento se hace acceder el miembro viril. En el delito de violación inversa, el bien jurídico protegido es la libertad sexual de la persona, en este caso la libertad sexual del hombre, conducta que al no estar tipificada por ningún tipo penal en el Ecuador, deja abierta la posibilidad de que no se pueda sancionar a la mujer como sujeto activo de este delito. Es por ello que surge la necesidad de tipificar e incorporar a nuestro ordenamiento jurídico este delito, que en nuestro país se ha ignorado por completo y que constituye en la actualidad un problema social de relevancia.
