This work consists of an analysis of the constitutional hierarchy that the codification of the Constitution of 1998 grants to the international agreements. It is composed by three chapters that come across the following topics. The first chapter is an approximation to the concept of international agreement from the point of view of the international law. In this chapter the principles “Pacta Sunt Servanda” and “Internal Law and Observance of Treaties” are analyzed. The second chapter consists of an analysis of the existing constitutional procedures to celebrate international agreements. In this chapter special emphasis is done in the difference of two procedures established at the Constitution. Finally the third chapter analyzes the weak points and the strong points of the different doctrinaire existing positions on the constitutional hierarchy of the international agreements. The principal doctrinaire existing positions are three.
Este trabajo consiste en un análisis de la jerarquía constitucional que la codificación de la Constitución de 1998 les otorga a los tratados internacionales. El mismo está compuesto por tres capítulos que topan los siguientes temas. El primer capitulo es un acercamiento al concepto de tratado internacional desde el punto de vista del derecho internacional. En el mismo se analiza el principio del “pacta sunt servanda” y el principio de “el derecho interno y la observancia de los tratados”. El segundo es un análisis del trámite constitucional para celebrar tratados internacionales. En este capítulo se hace especial énfasis en la diferencia de trámites existentes en la constitución. Por último el tercer capítulo analiza los puntos débiles y los puntos fuertes de las diferentes posiciones doctrinarias existentes sobre el tema. Las principales posiciones doctrinarias existentes son tres.
