Description

The purpose of this paper is to analyze the Judicial Council procedure to the possible configuration of the disciplinary infraction denominated error inexcusable committed by judges in the exercise of their functions, and whose sanctions are the dismissal of the judicial official. To also analyze this issue in foreign legislation in order to clarify questions that as law professionals we have identified, and in this way establish clear parameters and guidelines that allow to know the scope of this disciplinary infraction and its effects, helping us to identify the elements that constitute this infraction, allowing us to create a definition that contributes to the qualification of the same in future cases, in order to avoid possible abuses of political power within the jurisdictional power, determining a limit between the performance of the administrative power and the action of the jurisdictional power.
La presente investigación pretende realizar un análisis sobre cómo el Consejo de la Judicatura ha procedido ante la posible configuración de la infracción disciplinaria denominada error inexcusable, cometida por jueces en ejercicio de sus funciones, cuya sanción es la destitución del funcionario judicial, así como también analizar el tema en la legislación comparada, con la finalidad aclarar algunas interrogantes que como profesionales del derecho hemos identificado, desde que el Consejo de la Judicatura en transición entró a ejercer sus funciones, y de esta manera establecer parámetros y directrices claras que permitan conocer el alcance de esta infracción disciplinaria y sus efectos, y que ayude además a identificar los elementos que configuran esta infracción, que nos permitan crear una definición que aporte a la calificación de la misma en casos futuros, para así evitar posibles abusos del poder político dentro del poder judicial, determinando un límite entre la actuación de la potestad administrativa y la actuación de la potestad jurisdiccional.
