Description: The present work aims to warn the reader about the need to amend Articles 437 A to 437 J of the Criminal Code, which are responsible for behaviors that threaten sanctions against the environment. After a lengthy analysis of the fundamental concepts of Environmental Law, Criminal Law and the Constitution in force, is determined to be necessary that the legislative reform of these rules, to find agreement with the fundamental law and ensure that the penalties to be increased fulfill their preventive role.
El presente trabajo tiene por objetivo el advertir al lector, sobre la necesidad de reformar los artículos 437 A al 437 J del Código Penal ecuatoriano, los cuales se encargan de sancionar las conductas que atentan en contra del medio ambiente. Tras un largo análisis de las nociones fundamentales del Derecho Ambiental, del Derecho Penal y de la Constitución vigente, se determina que es imperante que el legislativo reforme dichas normas, para que encuentren concordancia con la Norma Fundamental y para que las penas al ser incrementadas, cumplan su rol preventivo.
