The purpose of this research is to expose the limits of liability within the relations between passengers and airlines. This work is focused on demonstrating that these limits input into liability matters, especially into those related with damage towards passengers, are determined mainly by The Warsaw System and the Aeronautical Code. This fact is to be considered as unconstitutional and out of relation with the American Convention on Human Rights. Therefore, and as a result of this abstract, it is to be understood why the complete reparation of damages caused by airborne activity is not only fairer and more efficient, but also totally supported by the existing legal system. This study will explore the limits of contractual liability in order to expose it as unconstitutional, within the use of a comparative analysis among the Constitution, the doctrine, the International Law and the jurisprudence made to support the contents of this work.
La presente tesis expone los límites de la responsabilidad en las relaciones de pasajeros y aerolíneas. De esta manera, pretende comprobar que dichos límites a la responsabilidad, específicamente a la reparación de los daños hechos a pasajeros, están impuestos principalmente por el Sistema de Varsovia y el Código Aeronáutico, hecho que consideramos inconstitucional e inconsistente con la Carta Interamericana de Derechos Humanos. Producto de este breve resumen, se entenderá porque la reparación integral de los daños resultado de la actividad aérea, no solo que es más justa y eficiente, sino que también está sostenida por todo el aparato jurídico vigente. En suma, esta tesis estudiará los límites de la responsabilidad contractual para poder evidenciar la inconstitucionalidad de los mismos, por lo que se hará un estudio comparativo de la Constitución, la doctrina, la jurisprudencia y la legislación internacional para sostener la tesis.
