This dissertation seeks to examine if the provisional measures ordered by an International Arbitration Tribunal are binding on states. In order to get there, I will analyze the different conventions and the various regulations of each of the major International Arbitration Centers, and primarily analyze cases in which Tribunals have ordered provisional measures, and therefore determine whether the state has complied with the provisions of the Tribunal. In this dissertation we mainly analyze cases in which Ecuador is involved, where not only we can find several decisions of arbitral tribunals for provisional measures, but also a ruling from the Supreme Court of Justice of Ecuador, which advocates for enforcement of these measures when ordered by international courts.
La presente tesis busca analizar, si las medidas cautelares dictadas por un Tribunal de Arbitraje Internacional son de obligatorias para los estados. Para ello analizaremos lo establecido en los distintos Reglamentos de los Centro de Arbitraje Internacional, y principalmente analizaremos casos en los cuales los tribunales han ordenado medidas cautelares para determinar si los estados han cumplido o no con lo dispuesto por los Tribunales. Hay que manifestar que en el presente trabajo hemos analizado principalmente los casos en los que se encuentra involucrado el Ecuador, en donde no solamente hay varias decisiones de Tribunales Arbitrales a favor de las medidas provisionales, sino que también una sentencia de parte de la Corte Suprema de Justicia que se pronuncia a favor del cumplimiento obligatoria de estas medidas cuando son ordenadas por los tribunales Internacionales.
