“LOS ESTUDIANTES INFRACTORES Y LAS ACCIONES EDUCATIVAS DISCIPLINARIAS”; es una investigación en la que se trata de determinar cuán eficaz es la aplicación de las sanciones educativas, conocidas en el ámbito académico como “disciplinarias”, por considerar que existe un vacío en el procedimiento que encamine a la recuperación psicopedagógica de estudiantes infractores posterior a la separación definitiva de la institución y a su reubicación tal como lo establece el Art. 331 numeral 3 literal ii del Reglamento General a la LOEI. La investigación se la realizó en las instituciones educativas del cantón Ambato del Distrito Educativo Ambato 18D02, utilizando los instrumentos de observación de campo como: entrevistas, encuestas y el estudio de casos reales, en los que se evidencia que el procedimiento sancionatorio, no norma recibir un tratamiento previo obligatorio como parte de la sanción, evitando trasladarse el inconveniente a otra institución educativa y por ende ampliar su campo de acción. Mediante la determinación de los hechos, los grados de infracción y los niveles de afectación individual y colectivo ha sido posible diagnosticar qué tipo de conflicto se está produciendo y el tipo de acción educativa disciplinaria a aplicarse por parte de la Junta Distrital de Resolución de Conflictos, primordialmente en los casos de faltas muy graves, dando así soluciones no solamente para el bienestar educativo, sino para que el estudiante infractor pueda mejorar su calidad de vida tanto como persona, compañero de aula e hijo, a través de una terapia integral enmarcada en el respeto a sus derechos.
“INFRINGING STUDENTS AND DISCIPLINARY EDUCATIONAL ACTIONS"; is an investigation in which, it is attempted to determine how efficient is the application of the educational sanctions, known in the academic field as “disciplinary”, for considering that exists a vacuum in the procedure that leads to the psychological recuperation of the infringing students once they were definitively separated from the institution and reallocated as stablished in the Art. 331 numeral 3 literal ii of the General Regulation of the LOEI. The investigation it was made in the educational institutions of the Educational District Ambato 18D02 of the canton of Ambato, using the field observation instruments as: interviews, surveys, and the study of real cases, in which is shown that the sanction procedure, it doesn’t dictates receiving a previous obligatory treatment as part of the sanction, avoiding transferring the inconvenient to another educational institution and expanding its action field. By establishment of the facts, the infraction degrees and the levels of individual and collective affectation, it has been possible to diagnose which kind of conflict it’s developing and the type of educational disciplinary action it is to be applied on behalf of the District Board of Resolution Of Conflicts, primarily in the cases with serious offenses, giving that way solutions, not only for the educational benefit, but also for that the infringing student could improve his life quality as a person, as a schoolfellow, and as a family member, through integral therapy, framed in the respect of his rights.
