El presente trabajo de graduación titulado: “LA VIOLACIÓN CON MUERTE A NIÑOS O NIÑAS Y LA REGULACIÓN DE PENAS EN EL CÓDIGO ORGÁNICO INTEGRAL PENAL”, propone implantar la reparación integral de la víctima por parte del Estado. En Ecuador el delito de violación con muerte causa gran conmoción social entre sus habitantes, la Policía Nacional por medio de la DINASED manifiesta que en el 2014 se dieron 5 y 2015 6 casos dándose un incremento, claro está que las cifras registradas no son tan extensas, pero al ser la víctima un niño o niña y por ser considerados como grupo de atención prioritaria preocupa a la población en general por la vulneración de derechos fundamentales establecidos en la Constitución como el derecho a la vida, el derecho a la integridad física, moral y sexual. El Código Orgánico Integral Penal llamado COIP, que entró en vigencia en el año 2014 tipifica y sanciona las infracciones penales, el delito de violación con muerte de niños o niñas es sancionado con pena privativa de la libertad de veintidós a veintiséis años, se toma en cuenta las circunstancias de la infracción, así como la reparación integral de la víctima tratando así que el condenado pague el daño material, personal o el daño social causado. Con la información recolectada y una vez realizado el análisis e interpretación de los resultados se considera que la reparación integral de la víctima la debe asumir el Estado Ecuatoriano siempre y cuando el condenado no cuente con los recursos necesarios ya que implantando esta medida en el Código Orgánico Integral Penal COIP, se podrá efectivizar de manera eficaz la reparación integral de la víctima, a sus familiares y la sociedad en general. Por lo que se puede decir que este trabajo de investigación es de importancia y transcendencia, pues se pretende reformar el artículo 171 en lo referente a la violación con muerte de niños tratando así de no vulnerar derechos constitucionales e internacionales de los niños.

The Comprehensive Criminal Organic Code called COIP, which entered into force in 2014 typifies and punishes criminal offenses, the crime of rape with the death of children is punishable by a custodial sentence of twenty-two to twenty-six years, is taken in Account the circumstances of the offense, as well as the integral reparation of the victim, thus treating the convicted person to pay the material, personal or social damage caused. With the information collected and after the analysis and interpretation of the results, it is considered that the integral reparation of the victim must be assumed by the Ecuadorian State provided that the condemned person does not have the necessary resources since implementing this measure in the Organic Code Integral Penal COIP, the full reparation of the victim, his / her relatives and society in general may be effectively effectuated. From what can be said that this work of investigation is of importance and transcendence, since it tries to reform article 171 in relation to the violation with the death of children thus trying not to violate constitutional and international rights of the children.
