總結:The development of this prior to obtaining a law degree, revolves around the derivative problems of the right to due process in disciplinary proceedings of teachers in research establishments. This research aims to conduct a thorough legal, critical and doctrinal analysis of the constitutional norms and protection of teachers has been subjected to a disciplinary process in educational institutions. Through the development of theoretical and empirical content has been achieved infer that currently the administrative disciplinary proceedings of teachers, does not meet the guarantees of due process and principles pro-Omine and pro-worker established in our constitutional law. Teachers face a lack of impartiality procedure where due process. Although the disciplinary procedure is the way to self-regulation of behavior of teachers who give their human contingent on state agencies, who in their capacity as public servants are in accordance with public law for the regulation of recruitment, punishment and the worst case, his dismissal; however, the conduct of the administrative disciplinary proceedings in Ecuador, still has problems and legal shortcomings that violate basic principles and guarantees, such as the effective, impartial and expeditious rights and interests of the public servant guardianship. Further, in the development of research I expose what prescribe the laws of other countries which by their proximity, are influential to our own rules, and which some circumstances be considered to be successful in formulating the will be taken. Finally, this work is corroborated by conducting a field study regarding the problem to investigate to what has obtained the judgment of a group of professionals in the legal sciences through technical survey and interview who have expressed their views and opinions regarding the proposed theme, suggesting legal incorporate the Organic Law of Intercultural Education reform
