Desde la constitucionalización de la justicia se ha previsto la necesidad de implementar medios para garantizar a la población el cumplimiento y protección de sus derechos, ya que la misma presenta deficiencias que afectan la aplicación de principios establecidos en nuestra normativa. El objetivo de este artículo es analizar al principio de especialidad y su vulneración conforme a lo que dispone el Código Orgánico de la Función Judicial frente a casos de garantías jurisdiccionales que son resueltas por jueces que no disponen de dicha especialidad para resolver dichos procesos.
Since the constitutionalization of justice, the need to implement means to guarantee the population the fulfillment and protection of their rights has been foreseen, since it presents deficiencies that affect the application of principles established in our regulations. The objective of this article is to analyze the principle of specialty and its violation according to the Organic Code of the Judicial Function in cases of jurisdictional guarantees that are resolved by judges who do not have such specialty to resolve such processes.
