El presente trabajo de investigación contiene un análisis sobre la tenencia y alimentos compartidos como un beneficio para garantizar el interés superior del niño y equiparar los derechos que como padres tienen, de manera que ninguno salga afectado luego de una separación o proceso de divorcio, ya que actualmente solo existe la tenencia unipersonal que generalmente se le da prioridad a la madre; y, si el padre pretende tener la custodia, comienza una lucha difícil e injusta entre los padres donde se vulnera el principio de igualdad y eso conlleva a una afectación en la estabilidad emocional del menor. Por lo tanto, la única manera de hacer que los operadores de justicia puedan garantizar los derechos tanto de los progenitores como del menor, es a través de la tenencia y alimentos compartidos a fin de que tanto el padre como la madre estén en las mismas condiciones de cumplir su rol según lo que establece nuestra Constitución de la República del Ecuador en su Art. 69, donde los padres están obligados al cuidado, crianza, educación, alimentación, desarrollo integral y protección de los derechos de sus hijos.
The present research work contains an analysis on the possession and shared food as a benefit for the best interests of the child and equating the rights that as parents have so that no one is affected after a separation or divorce process, since currently only There is one-person tenure that is normally given priority to the mother; And, if the father pretends to have custody, a difficult and unfair fight begins between the parents where the principle of equality is violated and that entails an affectation in the emotional stability of the minor. Therefore, the only way to ensure that justice operators can control the rights of both parents and children is through shared tenure and food so that both the father and the mother are in the same conditions of fulfill their role according to what is established in our Constitution of the Republic of Ecuador in its Article 69 where parents are obligated to care, upbringing, education, food, integral development and protection of the rights of their children.
