En el presente trabajo de titulación que tiene por nombre, LA VULNERACIÓN DEL PRINCIPIO DE IGUALDAD EN LOS INCIDENTES DE LAS PENSIONES ALIMENTICIAS, se desarrollará la idea de una vulneración al principio constitucional a la igualdad, dentro de nuestro ordenamiento jurídico, más centrado en el Derecho de Alimentos y sus incidentes, considerando que estos son aumento y rebaja del mismo. En este punto, se plantea una distinción en lo que se refiere al momento desde cuándo se debe, por un lado, el aumento de la pensión alimenticia resalta que se debe con la presentación a la demanda, mientras que en la rebaja se indica que se deberá desde la ejecutoria de la sentencia, tal distinción descrita en la normativa ocasionaría una vulneración a aquel principio que indica que todos somos iguales ante la ley. En esta investigación, se abordarán los puntos relacionados y característicos a estos derechos, traídos a conflictos en el presente trabajo, enfocándose debidamente en las consecuencias y efectos que acontecen en la práctica diaria de la profesión, para por último brindar un criterio y una recomendación a modo de solución de este conflicto que se genera en la ley.
In the present work that has the name, THE VULNERATION OF THE PRINCIPLE OF EQUALITY IN THE INCIDENTS OF FOOD PENSIONS, the idea of a violation of the constitutional principle of equality will be developed, within our legal system, more focused on the Law of Food and its incidents, considering that these are increases and decreases of the same. At this point, a distinction is made regarding the moment from when it is due. On the one hand, the increase in child support highlights that it is due with the presentation of the demand, on the other hand in the reduction it is indicated that must from the execution of the sentence, such a distinction described in the regulations would cause a violation of that principle that indicates that we are all equal before the law. In this investigation, the points related and characteristic to these rights, brought to conflict in the present work, will be addressed, duly focusing on the consequences and effects that occur in the daily practice of the profession, to finally provide a criterion and a recommendation to way of solving this conflict that is generated in the law.
