En el siguiente trabajo de titulación se analizó sobre la aplicación legal del artículo 169 numeral 6 del Código de Trabajo en base a la crisis que está viviendo el Ecuador debido a la pandemia por el virus Coronavirus (Covid 19) que ha golpeado a toda la economía de nuestro país y al mundo. En nuestro medio se han dado varias posturas con respecto a la aplicación de este numeral, ha sido común que empleadores se apoyen en esta medida para proceder a dar por terminado el contrato de trabajo, lo que evidencia la inadecuada aplicación del este artículo, aprobado mediante Acuerdo Ministerial, por lo tanto se cuestiona si ante los despidos que han acontecido tras la emergencia sanitaria, el mismo se ha aplicado bajo la legalidad y sobre todo bajo un seguimiento oportuno tomar tanto los contratantes como trabajadores para llegar así a generar una armonía en la relación tanto laboral como social entre conciudadanos a sabiendas que esta pandemia a golpeado a muchos sectores de la población en general.
In the following titling work, the legal application of article 169 numeral 6 of the Labor Code was analyzed based on the crisis that Ecuador is experiencing due to the coronavirus pandemic (Covid 19) that has hit the entire economy of our country and the world. In our environment there have been various positions regarding the application of this numeral, it has been common for employers to rely on this measure to proceed to terminate the employment contract, which shows the inadequate application of this article, approved by means of Ministerial Agreement, therefore it is questioned whether in the face of the dismissals that have occurred after the health emergency, it has been applied under the law and above all under a timely follow-up to take both the contracting parties and the workers in order to generate harmony in the both labor and social relationship between fellow citizens knowing that this pandemic has hit many sectors of the population in general.
