El presente trabajo tiene como finalidad evidenciar la necesidad de incluir al femicidio dentro del catálogo de delitos que pueden ser juzgados en ausencia del procesado, con el objeto de evitar impunidad y menoscabo a los derechos de las víctimas dentro de la realidad ecuatoriana. Para la consecución de tal objetivo, se ha efectuado una investigación cualitativa teórico descriptiva, ya que por medio de la doctrina se han obtenido los postulados necesarios para analizar la normativa ecuatoriana, el delito de femicidio en sus nociones generales y especiales, y las razones por las cuales dicho injusto debe juzgarse en ausencia del justiciable. Finalmente, se ha efectuado una investigación empírica, por medio de la realización de entrevistas a mujeres que tienden a dar su punto de vista sobre el problema jurídico planteado
The purpose of this work is to demonstrate the need to include femicide in the catalog of crimes that can be tried in the absence of the accused, in order to avoid impunity and impairment of the rights of victims within the Ecuadorian reality. To achieve this objective, descriptive theoretical qualitative research has been carried out, since through the doctrine the necessary postulates have been obtained to analyze the Ecuadorian regulations, the crime of femicide in its general and special notions, and the reasons why. which said unjust must be judged in the absence of the defendant. Finally, an empirical investigation has been carried out, through interviews with women who tend to give their point of view on the legal problem raised.
